1. Applicability and Scope
The following General Terms and Conditions (hereinafter referred to as “GTC”) apply to all business relationships between indyvit AG and customers for products purchased through our website [https://indyvit.com/].
Individual agreements concluded with the customer take precedence over these GTC. Any terms and conditions of the customer that conflict with or deviate from these GTC will not be recognized.
indyvit AG reserves the right to amend these GTC at any time. Any changes take effect upon publication of the new GTC on the website. The applicable version of the GTC is determined by the date on which the binding order is placed.
Please read these GTC carefully before placing a binding order. By placing a binding order, you agree to these terms and to our Privacy Policy, and you confirm that you are legally capable of entering into binding contracts and at least 18 years of age.
2. Conclusion of a Purchase Contract
The presentation of products in the online shop does not constitute a legally binding offer but rather a non-binding online catalog or invitation to customers to place an order. indyvit AG expressly reserves the right to change products, content (e.g., images, product range, prices, and descriptions), at any time and without prior notice. Illustrations, brochures, advertisements, and other product-related information are for informational purposes only and are not binding for indyvit AG.
Customers can place a binding order for selected products through our online shop. Adding items to the “shopping cart” does not yet constitute a binding order. An order becomes binding only once the customer clicks the “Buy Now” button at the end of the checkout process. Before submitting the order, the customer can review and modify all information, correct potential input errors, and make adjustments as needed.
An order confirmation will be sent automatically and immediately by email. This confirmation email contains your order details and our GTC as accepted during checkout. It serves only as confirmation that we have received your order. A purchase contract is not yet concluded by this confirmation. By submitting the order, you confirm that you have read and unconditionally agree to the GTC. We recommend printing or saving the GTC for your records.
After placing a binding order, indyvit AG may, at its sole discretion, accept or reject the order by notifying you via email. Any payment already made will be refunded in the event of cancellation. Reasons for rejection may include product unavailability, payment authorization failure, suspected fraud, violation of these GTC or individual agreements, or other significant reasons.
The purchase contract is concluded once the ordered products are shipped.
Any commercial distribution or resale of our products is strictly prohibited.
3. Availability and Reservation of Performance for Unavailable Products
All information regarding availability, shipping, and delivery is non-binding and for guidance only. They do not represent binding or guaranteed delivery dates. Liability for unavailable products or delivery delays is expressly excluded.
Our products are available while stocks last. If indyvit AG discovers during order processing that an ordered product is unavailable, you will be informed immediately. In this case, no contract is formed for the unavailable products.
We also reserve the right to limit the quantity of products that may be purchased by a customer. The customer will be informed of such limitations via email.
4. Prices and Shipping Costs
Our products and prices correspond to those stated on the website. All prices are quoted in CHF (Swiss francs) and include the statutory VAT (2.6% or 8.1%). The total order amount, including any applicable fees and shipping costs, will be displayed at the end of the checkout process.
By placing a binding order, you agree to the total price for the ordered products. Prices cannot be changed after a binding order has been placed.
indyvit AG reserves the right to change prices at any time. Products will be charged based on the prices applicable at the time of the binding order.
5. Payment Terms / Credit Check
Orders are generally due for immediate payment.
Customers may choose from the payment methods displayed on the website during checkout. These may vary over time. indyvit AG reserves the right to restrict certain payment methods in individual cases and to refer the customer to other available methods (e.g., based on creditworthiness). indyvit AG is expressly authorized to carry out credit checks and, if necessary, to share relevant data with third parties for this purpose.
By selecting a payment method, the customer authorizes payment via the entered credit card details or payment service provider credentials. The customer authorizes indyvit AG to collect payments accordingly. In the event of chargebacks, indyvit AG is entitled to reimbursement of related costs and bank fees. indyvit AG is not responsible for any fees or charges levied by your card issuer or bank.
If you pay by credit card or an alternative payment method, we reserve the right to verify the validity of the card, check authorization parameters, and request confirmation from the issuer. If payment is declined, indyvit AG may cancel the order and suspend shipment. In this case, you will be notified promptly.
Purchase on Account with Installment Option (POWERPAY) is available within Switzerland. MF Group / POWERPAY acts as an external payment service provider offering “purchase on account.” If payment is not made within the specified time frame, a monthly invoice will be issued. Upon completion of the purchase, POWERPAY assumes the claim and handles billing. By selecting this payment method, you also accept POWERPAY’s Terms and Conditions (powerpay.ch/de/agb). You will receive the invoice free of charge by email.
6. Special Conditions for Subscriptions and Installments
Customers can subscribe to regular deliveries or pay in monthly installments. In addition to these GTC, the following specific terms apply:
6.1
Customers may subscribe to various products. The delivery interval typically corresponds to the duration of an indyvit product (e.g., one jar) or, in the case of lab tests, a predefined interval. Customers may opt for monthly payments, paying one month in advance for each 30-day supply.
6.2
The seller offers the following payment methods for subscription services:

The first payment is charged upon confirmation of the initial order. Subsequent payments are charged before each shipment, or monthly in the case of installment payments. Payment data are stored securely with PayPal or Stripe, depending on the method used.
Promotional discounts (e.g., coupon codes) apply only to the first delivery unless otherwise stated. Any recurring discounts for future deliveries are displayed accordingly.
6.3
Subscription contracts are concluded for an indefinite period. Either party may cancel the subscription without providing reasons, with one week’s notice before the next scheduled delivery date. Delivery dates are listed in the customer’s account under “My Subscriptions.” Cancellation can be made via the customer account, email to customer service, or by calling the hotline.
If monthly payment is chosen, cancellation takes effect only after payment of the final due installment. Thereafter, the subscription automatically expires.
6.4
indyvit AG reserves the right to assign debt collection to Debtist GmbH, Taunustor 1, 60310 Frankfurt am Main, Germany for unsettled claims.
7. Delivery Conditions
Delivery is generally carried out by the Swiss Post. Products ordered through our online shop and in stock will be shipped, depending on destination, within 5 working days after full payment is received. A tracking number allows you to follow your order status.
If products are marked as out of stock, indyvit AG will make every effort to deliver them as soon as possible. While we strive to meet the stated delivery times, indyvit AG is not liable for delivery delays, regardless of cause. You will be informed promptly of any delays.
If a delivery obstruction persists for more than 3 weeks after the original delivery date, the customer may cancel the order. Further claims, particularly for damages, are excluded.
If delivery fails due to the customer’s fault after three attempts, indyvit AG may withdraw from the contract. Any payments already made will be refunded without delay.
8. Retention of Title
indyvit AG retains ownership of delivered products until full payment has been received.
9. Account Registration
By registering a customer account, you can view information about past, current, and recent orders, manage and store addresses, payment data, and newsletter preferences.
When registering, you must provide truthful and complete information. You are responsible for keeping your login details confidential and inaccessible to unauthorized third parties. indyvit AG treats your data confidentially and does not disclose it to unauthorized parties. Registration is free of charge. Each customer may maintain only one account. indyvit AG reserves the right to delete multiple accounts and warn, suspend, or modify users who violate these GTC or individual agreements.
indyvit AG is not obligated to accept a registration or an order from a registered user.
10. Complaints and Inquiries
We place great importance on customer satisfaction. You may contact us at any time via the contact information provided. We will review your inquiries or complaints as soon as possible and contact you after receiving the necessary information.
Please describe the issue clearly and include supporting documentation such as your order or customer number. We aim to respond within 5 working days.
11. Liability
indyvit AG is liable for damages resulting from intentional or grossly negligent breaches of duty. Liability for slight or moderate negligence, indirect, or consequential damages is expressly excluded. Examples of indirect damages include loss of profit, financial loss, reputational damage, or data loss resulting from temporary service interruptions. indyvit AG also assumes no liability for damages caused by auxiliary agents.
The above exclusions and limitations do not apply to cases of injury to life, body, or health caused directly by indyvit AG, or where mandatory legal provisions (including the Product Liability Act) apply.
Subject to the foregoing, total liability is limited to the purchase price of the product ordered.
Force Majeure
indyvit AG assumes no liability for failure or delay in fulfilling contractual obligations due to events beyond our control (“force majeure”), including but not limited to strikes, lockouts, wars, terrorism, natural disasters, epidemics, pandemics, or failure of communication or transport systems.
In such cases, we will inform you as soon as reasonably possible.
12. Data Protection
indyvit AG collects and processes personal data only within the framework of applicable data protection laws. For further details, please refer to our Privacy Policy, which forms an integral part of these GTC.
13. Copyright
All information and content published on the website are protected by copyright and are the property of indyvit AG or the respective rights holder. Reproduction, editing, distribution, or any form of use requires prior written consent of the rights holder. indyvit AG and the respective rights holder expressly reserve all rights.
14. Severability Clause
If any provision of these GTC is deemed illegal, invalid, or unenforceable, the remaining provisions remain unaffected. Unless otherwise agreed, an invalid provision shall be replaced by a valid one that most closely reflects the economic purpose and intent of the original provision. The same applies to any contractual gaps.
15. Applicable Law and Jurisdiction
These GTC and all related contractual relationships are governed exclusively by substantive Swiss law, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG).
For natural persons, jurisdiction lies either at the registered office of indyvit AG or at the customer’s place of residence. For legal entities, jurisdiction is exclusively at the registered office of indyvit AG.
